This website is operated by Caught In Joy. Throughout the site, the terms "we," "us," and "our" refer to Caught In Joy. By visiting caughtinjoy.com, creating an account, purchasing a product, accessing streaming or downloads, buying a music license or synth preset, or using any part of the site, you agree to these Terms of Service and to the policies referenced here.

If you do not agree to these Terms, you may not access the website or use the Services.

Products and Services

Caught In Joy offers music downloads, streaming access, digital albums and music journeys, music licenses, synth presets, and physical merchandise. Some products are digital-only and are delivered through account access, streaming access, download links, files, license access, or other electronic delivery methods.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You are responsible for maintaining access to the email address and account used for your purchase.

Digital music purchases and streaming access

When you purchase music downloads, albums, music journeys, or streaming access, you receive access for personal listening and personal use only, unless you separately purchase a music license that expressly grants broader usage rights.

Digital music purchases do not transfer ownership of copyrights, master recordings, artwork, trademarks, or other intellectual property. All rights not expressly granted are reserved by Caught In Joy.

You may not resell, redistribute, re-upload, share, stream, broadcast, compile, sell, claim authorship of, or otherwise make the original recordings available as standalone audio, albums, files, playlists, streams, music channels, sample packs, datasets, or competing listening products.

Streaming access may require an internet connection, a compatible browser or device, and an active customer account. We may update, maintain, change, suspend, or discontinue streaming, downloads, or site features when needed for technical, operational, rights, security, or business reasons.

Music licenses

Music license products are governed by the license terms shown on the applicable product page at the time of purchase, and those terms are incorporated into these Terms. If a license product includes additional or more specific terms, those product-specific license terms control for that license.

Unless stated otherwise in the applicable license product, Caught In Joy music licenses are non-exclusive and royalty-free for completed works within the purchased license scope. "Perpetual" means that completed projects made within the licensed scope may remain live after the active license period ends, but renewal may be required to use the music in new projects after the license period.

License products may allow cutting, looping, editing, or adapting the music inside a licensed project. They do not allow resale, redistribution, standalone upload, standalone streaming, broadcasting, compiling, sublicensing, content-ID registration of the original recordings, or claiming authorship or ownership of the original Caught In Joy recordings.

The YouTube/podcast creator license is for eligible videos, podcasts, livestreams, and creator content within the product terms. It is not for games, apps, films, standalone music channels, sleep/study/focus/ambient music videos where the music is the primary content, radio-style streams, compilations, or re-uploads of the recordings.

The single-project soundtrack license covers one specific commercial title, such as one film, game, app, or art installation, and related trailers, teasers, and promotional materials for that same project.

The unlimited commercial license covers eligible projects created during the active license year, within the product terms, with renewal required for new projects after the active license year ends.

Synth presets

Synth preset purchases grant you a license to use the presets in your own music, sound design, performances, recordings, and productions. You may release music or audio you create using the presets.

You may not resell, redistribute, share, upload, repackage, convert, include in another preset pack, or claim authorship of the original preset files or preset collection.

Physical merchandise

Physical merchandise is subject to availability, production, fulfillment, shipping, and return terms. Product images, colors, sizing, and descriptions are provided as accurately as reasonably possible, but display differences may occur.

Refunds and returns

Returns and refunds are governed by our Refund policy. Digital products, including downloads, streaming access, synth presets, and music licenses, are final sale once delivered, accessed, or downloaded, except as described in the Refund policy.

Prices, changes, and availability

Prices and product availability may change without notice. We reserve the right to modify, suspend, discontinue, limit, or refuse any product or Service at any time, subject to applicable law.

Account and access rules

You are responsible for keeping your account credentials secure. You may not share account access, download links, licensed files, or digital access credentials with others. We may suspend or terminate access if we believe an account is being used fraudulently, unlawfully, abusively, or in violation of these Terms or any license terms.

Prohibited uses

You may not use the site, Services, products, downloads, streams, licenses, presets, or content for any unlawful purpose; to infringe intellectual property or privacy rights; to harass, abuse, defame, or harm others; to submit false or misleading information; to distribute malware; to scrape, copy, harvest, or misuse data; to bypass access controls; to interfere with security features; or to violate any applicable law or regulation.

Intellectual property

All content on the site and all Caught In Joy music, recordings, artwork, presets, text, logos, product names, and other materials are owned by Caught In Joy or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms or in the specific product or license terms for your purchase.

Third-party tools and links

The Services may include links to third-party websites or tools. We are not responsible for third-party content, policies, services, or practices. Your use of third-party services is at your own risk and may be subject to separate terms.

Errors and inaccuracies

Occasionally there may be information on the site or in the Services that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, availability, shipping, or other details. We reserve the right to correct errors and update information, including after an order has been submitted, where permitted by law.

Disclaimer of warranties

The Services and products are provided on an "as is" and "as available" basis except as expressly stated by us. We do not guarantee that the Services will be uninterrupted, secure, error-free, or that all products will meet every subjective expectation or creative use case.

Limitation of liability

To the maximum extent permitted by law, Caught In Joy and our affiliates, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost data, replacement costs, or similar damages arising from your use of the Services or products.

Indemnification

You agree to indemnify, defend, and hold harmless Caught In Joy and our affiliates, service providers, and licensors from any claim or demand arising out of your breach of these Terms, misuse of the Services or products, violation of license terms, violation of law, or infringement of the rights of another party.

Severability and entire agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions will remain enforceable. These Terms, together with applicable policies and product-specific license terms, constitute the entire agreement between you and us regarding the Services.

Governing law

These Terms and any separate agreements whereby we provide Services are governed by the laws of the United States, except where applicable law requires otherwise.

Changes to these Terms

We may update or replace these Terms from time to time by posting changes on this page. Your continued use of the site or Services after changes are posted constitutes acceptance of the updated Terms.
